AI Usage and Training Policy
This AI Usage and Training Policy (this "Policy") sets forth how TOKOSEKI ("we," "us," or "our") handles data, whether data is used for model training, and the precautions that apply when AI features or AI-related technologies are used in the websites, web applications, and other related services we provide (collectively, the "Services"). Contractors and Users who use the Services shall use the Services after understanding this Policy.
Article 1 (Purpose)
This Policy is intended to clarify the scope of use of AI Features in the Services, the handling of User Data, our policy on use for AI model training, the use of External AI Services, and precautions regarding AI Output.
Article 2 (Definitions)
The terms used in this Policy are defined as follows. Terms not defined in this Policy have the meanings set forth in the Terms of Service and Privacy Policy.
- "AI Features" means features in the Services that use AI Models or machine learning technologies to generate, transform, classify, extract, or assist with text, images, layouts, setting proposals, analysis results, suggestions, summaries, or other information.
- "AI Model" means generative AI, machine learning models, classification models, inference models, or similar technologies provided, operated, or used by an external service or by us.
- "Input Data" means information that a Contractor or User enters, selects, sends, or causes an AI Feature to reference when using an AI Feature.
- "AI Output" means information generated, transformed, classified, extracted, or presented by an AI Feature.
Article 3 (Scope of Use of AI Features)
- We may use AI Features or AI-related technologies to the extent necessary to provide and operate the Services, including service provision, operation, feature improvement, initial setup assistance, layout generation, text generation, analysis support, support responses, incident investigation, and security response.
- The scope of AI Features, available data, generated content, usage conditions, and other details will be provided by displays within the Services, help pages, pricing plans, admin screens, or other methods we deem appropriate.
- We may add, change, suspend, or discontinue AI Features.
Article 4 (Handling of Input Data)
- We may process Input Data, related settings, operation information, logs, error information, and other information necessary to provide and operate AI Features to the extent necessary for providing AI Features.
- Contractors and Users shall confirm that they have the necessary rights, authority, permissions, and consent for information they enter into or cause AI Features to reference.
- Contractors and Users must not enter into AI Features any third-party personal information, confidential information, information that infringes rights, or information whose input is restricted by law or contract without the necessary authority or consent.
Article 5 (Use for AI Model Training)
- We do not use User Content registered, posted, uploaded, entered, or stored in the Services by Contractors or Users for the purpose of training AI Models of us or third parties.
- When we use External AI Services to provide AI Features, we will endeavor, to the extent reasonably available to us, to select settings, contractual terms, or service forms under which Input Data and AI Output are not used to train AI Models of the External AI Service provider.
- Notwithstanding the preceding two paragraphs, we may review, store, or process Input Data, AI Output, logs, and other necessary information to the extent necessary to ensure the safety of AI Features, prevent unauthorized use, investigate incidents, confirm quality, comply with laws, respond to disputes, and otherwise provide and operate the Services.
Article 6 (Use of External AI Services)
- We may use External AI Services, cloud services, APIs, analytics services, monitoring services, and other external services to provide and operate AI Features.
- When External AI Services are used, Input Data, AI Output, operation information, logs, and other necessary information may be sent to, stored by, or processed by the provider of the relevant External AI Service or related infrastructure.
- When using External AI Services, we will select and manage them within a reasonable scope based on the service content, information handled, countries or regions involved, security level, contractual terms, terms of use, data use policies, and other circumstances.
Article 7 (Nature of AI Output)
- AI Output may contain errors, inaccuracies, outdated information, bias, incomplete information, issues involving third-party rights, or other inappropriate content.
- When using AI Output, Contractors and Users shall review the content at their own responsibility and, as necessary, make corrections, delete content, re-check information, or take other appropriate measures.
- We do not warrant that AI Output will fit the purpose of a Contractor or User, be accurate or complete, avoid infringing third-party rights, or comply with laws or contracts.
Article 8 (Prohibited Acts)
Contractors and Users must not engage in the following acts when using AI Features.
- Acts that violate laws, public order and morals, the Terms of Service, or this Policy
- Entering third-party personal information, confidential information, or information that infringes rights without necessary authority or consent
- Unauthorized access, vulnerability testing, reverse engineering, prompt injection, or other acts that undermine the safety of the Services or External AI Services
- Using AI Output to engage in false information, discriminatory expression, illegal acts, rights infringement, impersonation, unauthorized use, or other inappropriate conduct
- Attempting to circumvent the specifications, restrictions, safeguards, or usage limits of AI Features
- Other acts that we reasonably determine to be inappropriate
Article 9 (Logs and Quality Management)
- We may acquire, store, and review Input Data, AI Output, operation logs, error logs, usage status, and other necessary information to provide and operate AI Features, investigate incidents, prevent unauthorized use, respond to security issues, confirm quality, analyze usage, comply with laws, and respond to disputes.
- We will reasonably determine the retention period, retention scope, and review method for logs based on the purpose of use, risks, laws, contracts, system constraints, and other circumstances.
- We may use statistical or aggregated information to improve the quality of AI Features. However, we do not use User Content for the purpose of training AI Models.
Article 10 (Responsibilities of Contractors and Users)
- Contractors are responsible for managing use of AI Features by Users under their management, including usage authority, Input Data, review of AI Output, and compliance with internal rules or organizational policies.
- When using AI Output for decision-making, publication, distribution, external submission, business use, or other important purposes, Contractors and Users shall carry out necessary confirmation, review, legal checks, rights checks, and other appropriate procedures.
- Members and other Users under a Contractor's management shall use AI Features in accordance with the policies, authority, and procedures established by the Contractor.
Article 11 (Relationship with This Policy, Terms of Service, and Privacy Policy)
- In addition to this Policy, the Terms of Service, Privacy Policy, Security Policy, and other rules established by us apply to the use of AI Features and AI-related technologies.
- Matters not provided for in this Policy are governed by the Terms of Service, Privacy Policy, and Security Policy.
Article 12 (Changes to This Policy)
- We may change this Policy due to changes in laws, business content, Service specifications, additions or changes to AI Features, changes to External AI Services, operational necessity, or other circumstances.
- The revised Policy becomes effective when it is posted within the Services, published on our website, or otherwise notified or announced by a method we deem appropriate. If procedures are separately required by law, those procedures will apply.
